Surya National & Legal Desk, New Delhi: Key leaders of the 'Cockroach Janata Party' (CJP) Sourav Das and Ashutosh Ranka approached the Delhi High Court challenging the extension of judicial custody imposed by the Special Executive Magistrate (SEM) in the case of protests against the resignation of the Election Commission's Chief Commissioner and the Special Comprehensive Amendment (SIR) process. The court was requested to conduct an urgent hearing on the petition stating that preventive detention laws and orders of refusal of bail surety passed by the police in the name of maintaining law and order are unconstitutional.
Petition that the right to protest at Jantar Mantar has been violated: The petitioners have alleged that the police have violated the fundamental right to peacefully protest with the national flag at the Jantar Mantar in Delhi. They brought to the notice of the court that the bail process by the Executive Magistrate's Court was being unnecessarily delayed and illegal detention was being extended by denying sureties on unclear grounds. There was a lot of excitement in the political circles: They said that the Magistrate had passed the order without considering their arguments fully, so they wanted to cancel the order and release them immediately.
The CJP groups are demanding that the partisan actions against the youth who question democratically should be stopped. The directions of the Delhi High Court on this key petition will gain prominence in the politics of the national capital.
