A Los Angeles court judge has dismissed Oliver Martinez's domestic violence restraining order (DVRO) petition against Halle Berry.
In early October, Oliver obtained a temporary restraining order against Halle Berry for allegedly physically assaulting his 13-year-old son Maceo, but the court dissolved that order after a fresh hearing. Halle Berry vehemently denied the allegations made by Oliver and made it clear in her declaration submitted to the court that she had never abused her son in any way and that she herself was a victim of domestic violence. Although Halle Berry got a reprieve from the dismissal of the restraining order petition, the main dispute over the son's custody is far from over.
While Oliver Martinez currently has primary physical custody, the court has maintained joint legal custody and temporary visitation rights for Halle Berry. The next hearing on this dispute will be held in the month of November.
